Your US State Privacy Rights
If you are a resident of California or certain other states in the U.S., you may have the following rights regarding your personal information (each of which are subject to various exceptions and limitations):
- Access - You have the right to request, up to two times every 12 months, that we disclose to you the categories of personal information collected about you, the categories of sources from which the personal information is collected, the categories of personal information sold or shared, the business or commercial purpose for collecting, selling, or sharing the personal information, the categories of third parties with whom personal information was shared, and the specific pieces of personal information collected about you.
- Correct - You have the right to request that we correct inaccurate personal information collected from you, subject to certain exceptions allowed applicable law.
- Deletion - You can request that we delete your personal information that we maintain about you, subject to certain exceptions.
- Opt-out of Targeted Advertising and Sale/Sharing of Personal Information - You can ask to opt-out of the sale of your personal information to, or the sharing of it with, a third party. For purposes of this privacy policy:
- "Sell" means the sale, rental, release, disclosure, dissemination, availability, transfer, or other oral, written, or electronic communication of your personal information to an outside party for monetary consideration or – under California law--other valuable consideration and
- “Share,” “shared,” or “sharing” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating your personal information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
- “Targeted Advertising”(under Virginia law) means the display of ads to a consumer where the advertisement is selected based on personal data obtained from that consumer’s activities over time and across nonaffiliated websites or online applications to predict preferences or interests.
Some browsers offer you the ability to opt out of cookie-based and other online tracking, which may be considered a “sale” or “sharing” of your personal information or may be used to collect personal information for targeted advertising. At this time, we only respond to browser-based opt-out signals sent through the Global Privacy Control: https://globalprivacycontrol.org/. When you opt-out of sale or sharing via the GPC, we honor your preferences, however, we may not be able to associate your preferences with other devices or interactions you have with us if you have not logged in to an account or otherwise provided your identity. In that case, we will apply the opt out to the personal information associated with the browser that sends the opt out signal. . We do not respond to other types of browser based signals that do not meet applicable state law requirements, which may include older Do Not Track signals.
As a reminder, please note that under applicable law your right to opt out does not apply to our sharing of personal information with service providers, parties we engage to perform functions on our behalf that are contractually obligated to use the data only to perform those functions for us.
- No Discrimination - You have the right not to be discriminated against for exercising these rights.
- Appeals - You have a right to appeal decisions concerning your ability to exercise your consumer rights.
We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.

You may designate an authorized agent to make a request on your behalf. When submitting the request, please ensure the authorized agent identifies himself/herself/itself as an authorized agent and can show written permission from you to represent you. We may contact you directly to confirm that you have authorized the agent to act on your behalf and confirm your identity. Notice of Financial Incentive. We may also offer you coupons, discounts or other promotions from time to time, such as when you provide us your email address or phone number and agree to receive marketing communications in exchange for a discount. Such offers may not be available at all times. The amount and terms of such offers will be presented to you at the time of the offer. A detailed description of how you can earn points through purchases through a membership in the First Chair program associated with your personal information is available here in the terms of the program. You can terminate your participation in these offers by emailing us at support.na@burton.com to opt out. Our good faith estimate of the value of your personal information is the value of the benefit we offer to you in each case. We have calculated that value by using the expense related to the benefit of the offer.

If you reside in California, you have the right to request and obtain a list of third parties, if any, to which your personal information (as defined by California law) has been disclosed for the third parties' direct marketing purposes during the immediately prior calendar year (e.g., requests made in 2021 will receive information about 2020 sharing activities, if any). California residents also have the right to opt out of having their personal information shared for direct marketing purposes. You may opt out or ask us one time each year if we have shared personal information with third parties for their direct marketing purposes.
